In response to the decision in Kelo v. City of New London, Sen. Tom McClintock has proposed legislation that would require a government to either own property it seizes or guarantee the public the legal right to use it should it be conveyed to a private party and to return it to the original owner should the use for which it was condemned cease. "
Maybe this is not a complete cure, but it is an attempt. Kelo is a contitutional abomination that eradicates the security in property rights previously guaranteed to individuals in this country when it was founded. Yet, a better call to battle could not have been issued to those whose interest should now be piqued as to the future nominees that will be considered for the Supreme Court, especially in light of Justice O'Conner's announced resignation and Justice Rhenquist's failing health.
